Terms of Service

All your rights under this Agreement are in addition to your rights as a consumer under applicable consumer protection laws, including the Australian Consumer Law. Your consumer rights are not excluded, restricted, or modified by this Agreement.

By placing an order with Forever by Muse (“FBM”), either online or in writing, you acknowledge that you have read, understood, and agree to be bound by the following terms and conditions:

DEFINITIONS

  • Agreement: The contract between Forever by Muse and You, effective from the date of your order confirmation.

  • Goods: The silk bouquets, floral arrangements, and related products or services supplied by FBM.

  • Damage: Any harm or loss to the Goods or third-party property caused by You or anyone You permit to handle or alter the Goods.

  • You/Your: The customer or client placing the order.

ORDERS AND QUOTES

  • All prices quoted are valid for 30 days from the date of the quote and are subject to GST and applicable taxes.

  • FBM reserves the right to amend prices prior to deposit payment if costs of materials or labor change.

  • For custom wedding styling or bespoke orders, a minimum 50% deposit is required to commence work.

  • For online shop orders, full payment is required before production begins.

  • Production and dispatch times are typically within 7 business days for online orders. Custom styling timelines will be confirmed separately.

  • Deposits are non-refundable once work has commenced or materials have been ordered.

DESIGN AND VARIATIONS

  • Designs provided by you (photos, sketches, or ideas) must be submitted prior to order confirmation.

  • FBM will endeavor to match designs but does not guarantee exact replication due to the handmade nature of the products.

  • Minor design variations may occur due to material availability and craftsmanship.

  • Any requested changes after production begins may incur additional costs and cannot be guaranteed.

PAYMENT TERMS

  • Payment must be made by the agreed due dates.

  • Outstanding balances not paid within 30 days of invoice may incur interest charges at 10% per annum (compounded daily).

  • FBM reserves the right to engage debt recovery services for overdue payments, with all associated costs payable by You.

SHIPPING AND DELIVERY

  • FBM ships Australia-wide and internationally. Shipping fees are calculated at checkout.

  • Delivery times vary by location and shipping method; estimated times will be provided at purchase.

  • FBM is not responsible for delays caused by courier services, customs, or unforeseen events.

  • Goods remain FBM property until paid in full.

  • By default, orders are shipped with “Authority to Leave” unless signature on delivery is requested.

RETURNS, REFUNDS & CANCELLATIONS

  • Due to the custom and handmade nature of our products, all sales are final.

  • Refunds or exchanges are only accepted for damaged or faulty items and must be reported within 7 days of delivery with photographic evidence.

  • Cancellation requests after order confirmation and production commencement may incur fees.

WARRANTY AND LIABILITY

  • FBM warrants that Goods will be free from defects at the time of dispatch.

  • FBM is not liable for damage caused by misuse, improper care, or accidents after delivery.

  • Liability for any claim is limited to the replacement of the Goods or refund of purchase price.

OWNERSHIP AND SECURITY INTEREST

  • Ownership of Goods transfers to You only after full payment is received.

  • You agree not to encumber or grant any security interest over the Goods until payment is complete.

INDEMNITY

You agree to indemnify and hold harmless FBM and its employees from any claims, losses, or damages arising from your use, handling, or misuse of the Goods or services.

FORCE MAJEURE

FBM is not responsible for delays or failure to perform due to causes beyond its control, including natural disasters, strikes, or government actions.

GOVERNING LAW AND JURISDICTION

This Agreement is governed by the laws of the State of Victoria, Australia. Any disputes will be subject to the courts located in Melbourne.

MISCELLANEOUS

If any provision is deemed invalid, the remaining terms will remain in effect. Failure by FBM to enforce any term does not waive its rights to do so later.
